1. Residential Payment Terms
Payment in full is due upon completion of services unless otherwise agreed in writing. Deposits may be required for equipment orders and installations.
2. 72-Hour Late Payment Policy
Invoices unpaid after 72 hours will be considered delinquent. The company reserves the right to:
- Suspend warranties
- Suspend future services
- Apply late fees
- Initiate collection process
- File mechanic’s lien
3. Interest & Late Fees
Late invoices may accrue interest pursuant to Arizona Revised Statutes §44-1201 plus administrative collection fees.
4. No Equipment Removal – Residential Properties
Installed HVAC equipment in residential properties is considered part of the home. The company will not remove installed systems due to non-payment. Instead, the company reserves the right to pursue collection remedies including lien filing and legal action.
5. Mechanic’s Lien Rights
The company reserves the right to file a mechanic’s lien under Arizona Revised Statutes §33-981 for unpaid labor, services, or materials.
6. Warranty Suspension
All warranties are suspended until payment is received in full.
7. Collection and Legal Costs
Customer agrees to pay attorney fees, court costs, and collection costs pursuant to A.R.S. §12-341.01.
8. Binding Agreement
Acceptance of estimate, invoice, or service constitutes agreement to these terms governed by Arizona law.
